Project Policy & Terms

Please find herein the terms of our project agreement.

Authorization. The named client is engaging 3:20 Designs, as an independent contractor for the specific project indicated in the package quotation. The client hereby authorizes 3:20 Designs to access their online applications and online store manager (if applicable) for design and maintenance purposes only.

Fees. The Client and 3:20 Designs mutually agree that the services described herein shall be completed for the total amount indicated in the package quotation, and it is upon this amount the first payment shall be determined and final payment due. Our Marketing Package monthly fees will be due on the 25th day of each month. Additional fees incurred during design would first be approved by customer and will be billed in a separate invoice.

Approvals. The project will be approved by the Client in phases as follows:

1. 3:20 Designs would provide Client with a sample/draft of the project’s “look and feel” based on instructions given by client during the design consultation (if applicable). All materials are due now (e.g. please submit written copy, photographs, graphics, logos etc) in order to keep production on schedule. Client would then send changes/edits from sample/draft.

2. 3:20 Designs would provide Client with a mock design of the project (if applicable). Client will then have the opportunity to make 2 design edits. Once approved, no substantial changes may be made after this point without necessitating additional costs and time for completion.

3. Upon receipt of the final payment, the project will be published and made public.

Timeline and Completion Date. We agree to work expeditiously to complete the project tasks indicated in the package quotation. If the Client does not supply 3:20 Designs with the material requested within 7 working days your production guarantee will be cancelled, and your project will be completed as our production schedule allows. It is understood that the completion date of this project may be delayed, and at the option of the Client, this contract may become null and void. Furthermore, the entire amount of the contract completed to date will become immediately due.

The client is allowed two (2) FREE rounds of changes/updates/revisions to the project during the design phase (each taking up to 1 hour in length for work done).

Payment.

Branding Starter Package: The price of the Branding Starter Package shall be determined using the quotation given. Any other fees and expenses (such as stock photo fees, scripts, and subscriptions) would first be approved by customer and will be billed in a separate invoice. This payment will be required at signing.

The monthly Marketing Package fee (amount based on package chosen) shall be due on the 25th of each month. Services will not begin for that next month until payment is received and/or processed. Any payments received after this period will incur a charge of 1.5% of current balance per day. 3:20 Designs reserves the right to remove designs due to delinquency in payment of this balance.

Website Development Project: The price of the Website Development Project can be paid in full or split into 2 payments if over $1500. Any other fees and expenses (such as stock photo fees, scripts, and subscriptions) would first be approved by customer and will be billed in a separate invoice. A payment of at least 50% of the total will be required at signing. The final payment is due on upon completion of the test site.

Assignment of Project. 3:20 Designs reserves the right to assign subcontractors to this project.

Warranty. 3:20 Designs does not warrant that the functions contained in these applications or website will be uninterrupted or error-free. The entire risk as to the quality and performance of these applications and website is with the Client. In no event will 3:20 Designs be liable to the Client or any third party for damages, including any lost profits, lost savings or other incidental consequential or special damages arising out of the operation of or inability to operate these applications or website, even if 3:20 Designs has been advised of the possibility of such damages. Within reason, 3:20 Designs may work with Client in resolving any issues that arise from incorrect coding and design.

Indemnification. The Client represents to 3:20 Designs and unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, or other artwork furnished to 3:20 Designs for inclusion in web pages comply with the Copyright Act of 1978 and its amendments, and/or the Client has permission from the rightful owner to use each of these elements, and will hold harmless, protect, and defend 3:20 Designs and its subcontractors, heirs and assigns, from any claim or suit arising from the use of such elements furnished by the Client.

Laws Affecting Electronic Commerce. From time to time governments enact laws and levy taxes and tariffs affecting Internet electronic commerce. The Client is solely responsible for complying with such laws, taxes, and tariffs, and will hold harmless, protect, and defend 3:20 Designs and its subcontractors heirs and assigns from any claim, suit, penalty, tax, or tariff arising from the Client’s exercise of Internet electronic commerce.

Invoices are payable upon receipt. A service fee of 1.5% each day will be applied to any balances unpaid after 5 days. 3:20 Designs will be entitled to collect any expenses, including reasonable attorney’s fees and costs, required to collect any sums due or to enforce the terms of this agreement. 320 Designs reserves the right to remove web pages from viewing on the Internet until payment is made.

Refund Policy. This agreement begins when the initial payment has funded. If the client halts work and applies in writing via email, work completed shall be billed at the hourly rate, and deducted from the initial payment, the balance of which shall be returned to the client. If, at the time of the request for refund, work has been completed beyond the amount covered by the initial payment, the client shall be liable to pay for all work completed at the hourly rate stated in the quotation.

Link Policy. If applicable, client agrees to place a link to the bottom of the homepage indicating that the site was designed by 3:20 Designs: “Web Design by 3:20 Designs”, with a return link back to our homepage.

Privacy Policy

This privacy notice discloses the privacy practices for 3:20 Designs and our website; https://www.320designs.com. This privacy notice applies solely to information collected by this website, except where stated otherwise. It will notify you of the following:

  • What information we collect;
  • With whom it is shared;
  • How it can be corrected;
  • How it is secured;
  • How policy changes will be communicated; and
  • How to address concerns over misuse of personal data.

Information Collection, Use, and Sharing 

We are the sole owners of the information collected on this site. We only have access to/collect information that you voluntarily give us via email or other direct contact from you. We will not sell or rent this information to anyone. 

We will use your information to respond to you, regarding the reason you contacted us. We will not share your information with any third party outside of our organization, other than as necessary to fulfill your request, e.g., to ship an order.

Unless you ask us not to, we may contact you via email in the future to tell you about specials, new products or services, or changes to this privacy policy. 

Your Access to and Control Over Information 

You may opt out of any future contacts from us at any time. You can do the following at any time by contacting us via the email address or phone number provided on our website:

  • See what data we have about you, if any.
  • Change/correct any data we have about you.
  • Have us delete any data we have about you.
  • Express any concern you have about our use of your data

Orders 

We request information from you on our order form. To buy from us, you must provide contact information (like name and shipping address) and financial information (like credit card number, expiration date). This information is used for billing purposes and to fill your orders. If we have trouble processing an order, we’ll use this information to contact you.

Sharing 

We partner with another party to provide specific services. When the user signs up for these services, we will share names, or other contact information that is necessary for the third party to provide these services. These parties are not allowed to use personally identifiable information except for the purpose of providing these services.

Security 

We take precautions to protect your information. When you submit sensitive information via the website, your information is protected both online and offline.

Wherever we collect sensitive information (such as credit card data), that information is encrypted and transmitted to us in a secure way. You can verify this by looking for a closed lock icon at the bottom of your web browser, or looking for “https” at the beginning of the address of the web page.

While we use encryption to protect sensitive information transmitted online, we also protect your information offline. Only employees who need the information to perform a specific job (e.g. billing or customer service) are granted access to personally identifiable information. The computers/servers on which we store personally identifiable information are kept in a secure environment.

Cookies 

We use “cookies” on this site. A cookie is a piece of data stored on a site visitor’s hard drive to help us improve your access to our site and identify repeat visitors to our site. For instance, when we use a cookie to identify you, you would not have to log in a password more than once, thereby saving time while on our site. Cookies can also enable us to track and target the interests of our users to enhance their experience on our site. Usage of a cookie is in no way linked to any personally identifiable information on our site.

Surveys & Contests 

From time-to-time our site requests information via surveys or contests. Participation in these surveys or contests is completely voluntary and you may choose whether or not to participate and therefore disclose this information. Information requested may include contact information (such as name and shipping address), and demographic information (such as zip code, age level). Contact information will be used to notify the winners and award prizes. Survey information will be used for purposes of monitoring or improving the use and satisfaction of this site.
